In September 2009 a new construction related legislation was adopted in Serbia. The new Law on Planning and Building brings a number of novelties aiming to provide help to investors and speed up the real estate development process. This text considers providing the land for construction, getting building permits, construction, obtaining using permit and registration in the cadastre.
In accordance to the new law the private ownership over land is resolved as well as further disposal of ownership rights. The right to private ownership will be set on in this year.
Location permit is needed for the purpose of designing, including the preparation of the final design. This permit is issued by local governments within 15 days from the day of submittal. The Location permit is in effect in two years and during that time the investor is obliged to request the issuance of the Building permit.
After the Location permit is obtained and the designing process is completed (which encompasses the general, conceptual, final, detailed and as-built design, the latter two don`t being mandatory at that point), the investor is entitled to apply for Building permit, in cooperation with a registered company or entrepreneur. Building permit is issued within 8 days and is valid for two years, and at that time the investor must start to build.
Not later than 8 days prior the commencement day the investor is due to report the kick off to the local government. The investor should prepare the plot for building and mark the building site. While building is under way the investor is obliged to provide legally mandatory supervision over the building process.
The Using permit is issued not later than 7 days after the technical acceptance committee announces the building is officially completed.
The last phase of the building process is the registration of the finished building in the state cadastre.
